By accessing or using Fly-eVisa’s platform (the “Service”), you agree to comply with and be bound by these Terms of Service. If you do not agree, you may not use our Service or book any Travel Services.

1. Acceptance of Terms

By creating an account, applying for a eVisa, booking travel services, or using our platform, you:

  • Confirm you are at least 18 years old (or the age of majority in your jurisdiction).
  • Agree to these Terms and our Privacy Policy.
  • Acknowledge that additional terms may apply to specific services (e.g., airline tickets, visa applications, eSIM connectivity).

Services Provided

Fly-eVisa operates as a comprehensive digital platform designed to streamline your travel planning and documentation needs. Below is an overview of the core services we facilitate:

1. eVisa Applications

  • Submission of Visa Applications: We assist in preparing and submitting visa applications to government authorities on your behalf, including required documentation (e.g., passport copies, photographs, and supporting letters).
  • Document Verification: Our system reviews your application for completeness and compliance with destination-country requirements before submission.
  • Government Liaison: We act as a conduit between you and immigration authorities, providing status updates and notifications regarding your application.
  • Visa Types: We facilitate applications for tourist, business, transit, and other visa categories, depending on destination-country availability.
  • Compliance Guidance: We provide checklists and guidelines to help you meet entry requirements (e.g., vaccination certificates, travel insurance).

2. Travel Bookings

  • Flight Reservations: Book domestic and international flights through our partnerships with airlines and global distribution systems (GDS).
  • Accommodation Reservations: Secure stays at hotels, resorts, vacation rentals, and other lodging options worldwide.
  • Car Rentals: Arrange vehicle rentals through third-party suppliers, with options for insurance coverage and additional drivers.
  • Travel Insurance: Offer curated insurance plans covering trip cancellations, medical emergencies, and lost luggage.
  • eSIM Connectivity: Provide prepaid eSIM plans for seamless mobile data access in your destination country.
  • Dynamic Pricing: Real-time pricing and availability for travel services, subject to change based on supplier updates.

3. Customer Support

  • Pre-Travel Assistance:
    • Guidance on visa requirements, processing times, and document preparation.
    • Help with booking modifications, cancellations, or refund requests (subject to supplier policies).
  • Technical Support:
    • Troubleshooting for account access, payment failures, or platform errors.
    • Assistance with downloading travel documents (e-visas, booking confirmations).
  • Post-Booking Support:
    • 24/7 emergency support for urgent travel disruptions (e.g., flight cancellations, visa denials).
    • Coordination with Travel Providers to resolve issues impacting your itinerary.

Important Notes

  • Intermediary Role: Fly-eVisa acts as a facilitator between you and third-party suppliers (e.g., airlines, hotels, immigration authorities). We do not directly provide travel services or visa approvals.
  • No Guarantees:
    • Visa outcomes depend solely on government authorities; we cannot influence approval decisions.
    • Travel bookings (flights, hotels, etc.) are subject to supplier availability and operational changes beyond our control.
  • Third-Party Reliance: Our Service aggregates information and bookings from external partners. While we strive for accuracy, we are not liable for errors in third-party data (e.g., incorrect visa fees, outdated travel advisories).

3. User Responsibilities

By using Fly-eVisa’s platform, you agree to the following obligations:

1. Provide Accurate and Complete Information

  • Ensure all details submitted for visa applications and travel bookings (e.g., full legal names, passport numbers, dates of birth, travel dates) match the information on official government-issued documents.
  • Promptly update your account or booking details if any information changes (e.g., passport renewal, contact information).
  • Acknowledge that inaccuracies, omissions, or mismatched data may result in:
    • Visa denials, delays, or cancellations by government authorities.
    • Additional fees for corrections or rebookings.
    • Travel disruptions (e.g., denied boarding, entry refusal).

2. Verify Travel Requirements

  • Independently confirm entry/exit requirements for all destinations, including:
    • Visa or electronic travel authorization (eTA) rules.
    • Passport validity periods (e.g., minimum 6 months beyond travel dates).
    • Mandatory vaccinations, health certificates, or COVID-19 testing.
  • Monitor travel advisories from official sources (e.g., government websites, WHO) for updates on safety, political unrest, or health risks.
  • Ensure compliance with local laws at your destination (e.g., customs restrictions, cultural norms).

3. Ensure Compliance for All Travelers

  • If booking for others (e.g., family, group travelers):
    • Obtain explicit consent to share their personal data and agree to these Terms on their behalf.
    • Verify that all travelers meet destination-specific requirements (e.g., visa eligibility, age restrictions, health protocols).
  • Acknowledge that Fly-eVisa is not liable for travelers’ failure to comply with entry rules (e.g., expired passports, insufficient documentation).

4. Lawful Use of the Service

  • Use the platform only for legitimate purposes and refrain from:
    • Fraudulent activities (e.g., fake bookings, chargeback abuse, use of stolen payment methods).
    • Exploiting promotions through multiple accounts or unauthorized methods.
    • Scraping data, deploying bots, or disrupting service operations.
  • Comply with all applicable local, national, and international laws, including:
    • Anti-money laundering (AML) regulations.
    • Export control and sanctions laws.
    • Intellectual property rights (e.g., unauthorized use of content).

5. Account Security

  • Safeguard your account credentials (e.g., username, password) and promptly report unauthorized access.
  • Accept responsibility for all activities conducted through your account, including bookings or changes made by third parties with your login details.

6. Indemnification

  • Agree to indemnify Fly-eVisa, its affiliates, and partners against losses arising from:
    • Your breach of these Terms.
    • Misuse of the Service or violation of third-party rights.
    • Costs related to resolving disputes (e.g., legal fees, government fines).

4. Account Management

  • Security: You are responsible for maintaining account confidentiality and reporting unauthorized access.
  • Termination: We reserve the right to suspend or terminate accounts for violations of these Terms.

5. Payments & Refunds

  • Fees: Service fees, government visa charges, and third-party costs will be disclosed before payment.
  • Refunds:
    • eVisa fees are non-refundable once submitted to authorities (even if denied).
    • Travel bookings follow the cancellation policies of the respective supplier (e.g., airlines, hotels).
  • Chargebacks: Unjustified chargebacks may result in account suspension and legal action.

6. eVisa-Specific Terms

  • Accuracy: You are solely responsible for ensuring the accuracy of visa application details. Errors may result in delays or rejections.
  • Government Discretion: Visa approvals are at the sole discretion of government authorities; we do not influence outcomes.
  • Data Sharing: By submitting an eVisa application, you authorize us to share your data with relevant government agencies.

7. Liability

Our liability:

  • We are not liable for:
    • Visa denials, delays, or errors by government authorities.
    • Travel supplier failures (e.g., flight cancellations, overbookings).
    • Indirect damages (e.g., lost profits, travel disruptions).
  • Our total liability is limited to the amount paid for the affected service.

Your indemnity: You agree to indemnify Fly-eVisa against claims arising from your misuse of the Service or violations of these Terms.

8. Dispute Resolution

  • Governing Law: These Terms are governed by the laws of Morocco.
  • Negotiation First: Parties agree to attempt informal resolution before pursuing legal action.
  • Jurisdiction: Disputes will be resolved in the courts of Rabat, Morocco, unless otherwise required by law.

9. Intellectual Property

All content on the platform (e.g., logos, software, text) is owned by Fly-eVisa or its licensors.

  • You may not copy, modify, or resell any part of the Service without written permission.

10. Updates to These Terms

We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance.
